These Terms and Conditions, together with our Privacy Policy, set forth the terms and conditions (also referred to as "Terms") that apply to your access to and use of all Financer.com products and Services (collectively, the "Financer.com Services" or "Services"), which are made available through our Sites, including, but not limited to, all content and Services provided in the socialfundinggroup.com domain, as well as through certain downloadable mobile applications or platforms that are authorized by socialfundinggroup.com to provide our Services (collectively, the "Site", or "Website"). "socialfundinggroup.com" includes socialfundinggroup.com Limited and its officers, directors, employees, consultants, affiliates, subsidiaries and agents. By using or accessing the socialfundinggroup.com Services, you confirm that you meet the requirements set forth herein and that you accept these Terms, as last updated.
In these Terms, "we", "us", "our", "Funder", "socialfundinggroup.com" refer to Finance Popular, a trading name of socialfundinggroup.com, a company registered in Paris, with its registered office at 31 BD DE MONTMORENCY 75016 PARIS 16.
"product", "service" or "service provider" means the manufacturer, supplier, distributor or provider of any service or product available on our Site, except for products or services provided by Finance Popular itself. Any reference to a product or service refers to products or services provided directly by Finance Popular in the event that they are written with capital letters.
"you" and "your" mean the person or entity accessing and using our Site.
Acceptance of these Terms and Conditions
If you access and use our Site, you agree to be bound by and act in accordance with these Terms and Conditions and our Privacy Policy. If you do not, or cannot, accept these Terms and Conditions or our Privacy Policy, you are not authorized to access and use the Site and you must immediately stop using or accessing the Content. If you fail to comply with these Terms and Conditions, your right to access and use the Site will cease immediately.
Our Services
Finance Popular is primarily a Financing Service that can be used to compare different financial services or products based on different information available. On our comparisons, we may provide information such as contact details, interest rates, ratings, reviews and product descriptions, among others. Other parts of our Service may also include, but are not limited to, financial news, general or specific financial information, savings tips, educational programs, rewards programs, incentive contests, etc.
Our educational programs may be free or subscription-based. The subscription-based educational programs we provide are under the trade name "Financer Academy", "Financer Courses" or simply "Academy".
The Academy subscription takes effect upon placing an order and will remain in effect until terminated in accordance with the disclaimers set forth in the subscription information pages, or in the official terms page.
The subscription will renew automatically at the same frequency as the original subscription plan, unless canceled in advance. To avoid being automatically billed, you must cancel your subscription before the end of your current subscription or free trial. Cancellation can be done on the user profile page, or by sending an email to contact@financepopular.com.
Finance Popular does not offer refunds for payments made on a recurring subscription plan after its renewal date.
If you cancel your subscription after paying for it, you will continue to have access until the end of the subscription period and will not be charged for the next billing cycle.
Failure to comply with our terms may result in Finance Popular suspending your subscription.
In addition to the refund policies set out above, if you have a right of withdrawal under the relevant laws of your country, including the applicable laws of the European Union, you have a right of withdrawal for a period of 14 days. You may withdraw your subscription to the Academy Services, without giving any reason, and without incurring any costs other than those provided for in this clause. The withdrawal period will expire after 14 days from the effective date of your subscription. However, you do not have a right of withdrawal if the Services have already been fully or partially delivered and consumed by you or any other user who has used your account.
To exercise the right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement, which will be provided by you to the following email address: contact@financepopular.com.
Finance Popular Services may also include access to third-party rewards programs; platforms that allow users to locate and contact third-party financial services, as well as professionals, such as third-party experts, advocates and advisors, who may provide various services; chat rooms, community forums, bulletin boards, review services and forums in which users can ask questions of third-party advisors; and platforms that allow users to apply for pre-qualification for certain credit card or loan offers.
We strive to provide accurate information for each service presented on our Site, but you understand that we are not responsible if this information is not accurate. You are responsible for conducting your own due diligence with multiple internal and external sources for each service you are considering using as a customer.
In order to obtain a result on a financial product through our comparison service, you may be asked to provide certain information, for example by choosing specific search parameters or answering questions. The information you provide will determine the products or services that are offered to you. You must obtain permission from any other person/company whose details you intend to use to apply for a financial product, before providing us with any information about them. This applies to all information you provide. By submitting another person's details, you confirm to us that you have their permission and that they understand how their information will be used. You are solely responsible for ensuring that you answer all questions truthfully and that all information you enter on Finance Popular is true, accurate and complete.
We have taken all reasonable steps to ensure that the information contained on this site is accurate and up to date. However, we cannot accept any liability for any errors or omissions. We reserve the right to add, change or remove information from this site at any time. Although we take all reasonable precautions to guard against viruses and other items that have contaminating or destructive properties, we cannot guarantee that this site and its contents are free of viruses or other items that have such contaminating or destructive properties.
We are not responsible for any comments, opinions, ratings or other postings on our site by any third party.
Competitions
All rewards or referral programs (also called "contests," "sweepstakes," "referrals," "competitions," or "giveaways") are governed by the following rules, numbered 1 through 25:
1. Each statement or provision is binding and is referred to as a "rule." All rules collectively constitute a subset of the Official Terms. In these Terms, the term "you" refers to you as the "participant" (also referred to as an "Entrant") in the Contest, who has voluntarily chosen to participate by first agreeing to the Terms. To agree to become a participant, you must first read, understand, comply with, agree to, and follow all of the Terms listed. “Finance Popular Email Lists”, “Finance Popular News”, “Finance Popular News List”, or simply “News” or “Newsletters” refers to our email lists, as further described in term number 24, and in our Privacy Policy. There may be multiple winners for each competition. The terms that apply to each winner will apply to all winners.
2. The Promotion is in no way associated with, administered by, or endorsed by Facebook, Instagram, Amazon or any other company other than Finance Popular (regardless of the platform on which the Promotion is run). By entering the Promotion, you acknowledge a full release of Facebook, Instagram, Amazon, Finance Popular or any other company’s employees, investors, stakeholders and partners from any and all liability in relation to your participation.
3. The Promoter is Finance Popular

The Promoter reserves the right to assign the entire promotion and all legal and operational responsibilities associated with it to business entities/individuals who are active partners or collaborators of the Promoter. In the event that the competition is organized by such a partner, the Promoter is fully released from any legal or operational liability associated with the promotion.
5. The competition is open to all adult residents, of all nations recognized by the UN, unless there is a legal requirement, rule, guideline, legislation or jurisdiction of any form or authority that prohibits or restricts participation. It is your own responsibility to consult your legal authorities and inform yourself whether you are permitted to participate in the competition or participate in any type of Services provided by Finance Popular and its affiliates or partners.
6. There is no entry fee and no purchase necessary to enter the competition.
7. You agree that by participating in any or all of the requirements of the Contest, you are officially participating in this Contest and agree to be bound by the terms and conditions as set out herein and any other associated rules posted on Finance Popular’s official posts.
8. Only one entry will be accepted per person or entity, unless otherwise specified by the Organizers. Multiple entries from the same entrant will be disqualified, unless explicitly stated in the Contest Terms.
9. The entry opening date is the date the official post is shared on the Organizer’s official social media channels, unless otherwise specified by the Organizers. Typically, this date is within the first week of a calendar month.
10. The closing date for entries will be the last day of each calendar month in which the Contest is announced, unless otherwise specified by the Organizers.
11. No responsibility can be accepted for entries not received for any reason.
12. The rules of entry are explained on the official competition post as posted on the promoter’s official communication channels, which includes the social media accounts or official company website posts.
13. The promoter reserves the right to cancel or amend the competition and these terms without notice in the event of disaster, war, civil or military unrest, force majeure or any actual or anticipated breach of any applicable law or regulation or any other event beyond the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
14. The promoter is not responsible for any inaccuracy of prize details provided to an entrant by any third party connected with this competition.
15. The prize is as follows: The prize is as stated on the official competition website, and no cash or other alternative will be offered. Prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without notice.
16. Multiple winners may be chosen for each given competition. The winner will be notified by email and/or Twitter/Facebook/Instagram DM and/or letter within 28 days of the closing date. If the winner cannot be contacted or does not claim the prize and does not accept the terms of claiming the prize within 2 days of notification (email and/or DM) by our team, we reserve the right to withdraw the prize from the winner and/or choose a replacement winner and/or declare the prize and competition invalid.
17. The promoter will inform the winner of the time and place where the prize can be collected/is delivered.
18. The decision of the Promoter on all matters relating to the Competition will be final and no correspondence will be entered into.
19. The Competition and these Terms and Conditions are governed by the laws of Malta.
20. By entering the Competition, the winner agrees to have their name and image used in any publicity material. Each winner is required to email us their own photo holding the prize or mentioning the prize within two days of its delivery to their nominated physical or virtual address. The winner also agrees to grant us permission to use any content provided to us for commercial purposes.
21. By entering the Competition, the entrant indicates that they agree to be bound by these Terms and Conditions.
22. All entrants agree to let us share, distribute, modify any content they have provided or shared on our official social media channels, including text, images, references or any other related content.
23. Any review provided for a business listed on Finance Popular must be authentic and reflect a real customer experience. Entrants will be disqualified if it is proven that their comments are not part of an authentic experience and interaction. It is not necessary to write a review for a business listed on Finance Popular to enter the Contest. If the entrant decides to write a review that is encouraged by the Contest, they must indicate this in the title of their review.
24. The only mandatory action to enter the Contest(s) is to subscribe to the Finance Popular mailing list(s). Our email lists have several scopes, including marketing, re-marketing, user support, user service, newsletters, account settings, privacy information, general requirements, specific user requests, or others. By subscribing to our email lists, the entrant agrees to their email being used for any of the above purposes as described in this clause 24, or for any other reason deemed appropriate by Finance Popular.
25. The Promoter reserves the right to cancel or amend the terms of the competition at any time, with or without notice.
Forum
User Generated Content
Finance Popular may offer features that allow users to share content, reviews, comments and opinions on financial topics with other users on the Site or on Finance Popular's social media pages, the Community Forum (if available), and other user discussion forum platforms (collectively, the "Forum"). Your use of the Forum is governed by these Terms and Conditions, as well as our Community Guidelines.
i) The content of the Forum is the contribution of independent users not affiliated with Finance Popular, whose opinions are their own. Finance Popular does not guarantee the accuracy, integrity or quality of the opinions and advice posted on the Forum. Your use of any user content provided on the Forum is at your own risk.
ii) any content you post on the Forum must not violate any applicable law, including, but not limited to, containing confidential information, trade secrets, personal information, rudeness or discrimination (national, religious, gender, age, etc.).
iii) Finance Popular may, but is not obligated to, monitor the content of the Forum and reserves the right to modify, edit or remove any content from the Forum for any reason, at its sole discretion.
iv) You hereby grant Finance Popular a royalty-free, perpetual, irrevocable, non-exclusive and transferable right and license to store, use, reproduce, modify, translate, transmit and distribute any content, information or material you submit or post on the Forum, in any media now existing or later developed, for any purpose, including commercial purposes.
v) We may terminate a user's access to or ability to use the Forum immediately, without notice, and at our sole discretion, if the user fails to comply with any term of the Terms and Conditions or the Community Guidelines.
Third Party Services
As we work with many providers, it is important that you read and accept the provider's terms and conditions before using any part of their service or purchasing a digital product, as they may differ from ours. Once you have used or purchased a product or service, it is important that you check that your details match those you have provided to us. You should also read all documentation provided to you by your chosen provider and ensure that you are aware of the levels of cover, financial limits and any other terms that apply. If any information is incorrect, it is your responsibility to identify the error and correct it directly with the provider.

You acknowledge and agree that Finance Popular has not reviewed the content, advertising, products, services, or other materials appearing on such third-party sites or services, and is not responsible for the legality, accuracy, or appropriateness of such content, and will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party sites or services.
Account Information
To use the Services, you must (i) be at least eighteen (18) years of age; (ii) have full legal capacity or have permission from your legal guardian; (iii) not have been previously suspended or removed from the Services; and (iii) register for and use the Services in compliance with all applicable laws and regulations.

Finance Popular assumes no responsibility for any leaks of your personal information resulting from your sharing of Registration Information with a third party or your failure to maintain the confidentiality of Registration Information.
Commercial Use
This site is intended for non-commercial use only, that is, for personal use or for use by a business to search for a product directly for that business only. Unauthorized commercial or bulk use may slow down the speed of the service we can provide to our customers. We will monitor the use of our Services. If we detect any commercial or bulk use before we have sent the results of our search, we may stop the search. In any event, we reserve the right to take action against those who use our Service in an unauthorized manner, to prevent disruption of our Service to genuine customers, and to recover any losses we suffer.
Termination
If you violate any of the Terms, your authorization to use the Services will automatically terminate. In addition, Finance Popular may, in its sole discretion, suspend or terminate your user account and/or suspend or terminate all or part of your access to the Services at any time, with or without notice. You may terminate your account at any time by contacting customer service at contact@financepopular.com. After termination of your account, the information and content you previously provided will no longer be accessible through your account, but Finance Popular may continue to store such information and content, and it may also be stored by third parties to whom it has been transferred through your use of the Services.
Community Guidelines
You agree not to:
Use the Services for any illegal purpose, or in violation of any local, state, national or international law;
Violate or encourage others to violate the rights of others, including intellectual property rights;
Post, upload or distribute any content that is unlawful, defamatory, inaccurate or that a reasonable person would consider to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful or otherwise inappropriate;
Interfere in any way with the security-related features of the Services;
Interfere with any user's operation or enjoyment of the Services, including by uploading or distributing viruses, adware, spyware, worms or other malicious code, making unsolicited offers or advertisements to other users or attempting to collect personal information about users or third parties without their consent;

Finance Popular reserves the right to modify these Terms at any time and to impose new or additional terms on your use of the Services. Such modifications and additional terms will be effective immediately upon posting on the Site and will be incorporated into these Terms. We will use reasonable efforts to notify you of any material changes to the Terms, including, but not limited to, by posting a notice on our Site or sending an email to any address you may have provided to us. Modification of Services
Finance Popular reserves the right to modify or discontinue, temporarily or permanently, all or any part of the Services at any time without notice or further obligation to you. While Finance Popular strives to maintain safe, secure, accurate and properly functioning Services, we cannot guarantee the continuous operation of or access to our Services, and there may occasionally be inadvertent technical or factual errors or inaccuracies.

Finance Popular does not endorse any advisor or other third party. Finance Popular acts solely as an intermediary between you and third-party service providers and expressly disclaims any liability for the content, products or services provided by such service providers. Limitation of Liability
In no event shall Finance Popular be liable to you for any incidental, special, consequential, direct, indirect or punitive damages, whether based on warranty, contract, tort (including negligence), statute or any other legal theory, whether or not Finance Popular has been informed of the possibility of such damages. Some jurisdictions do not allow the disclaimer of warranties or limitation of liability in certain circumstances. Accordingly, some of the above limitations may not apply to you.
In any event, the amount of Finance Popular's liability to you will not exceed the amount of monies received by Finance Popular from you in the last 12 (twelve) months (if any).
You understand that by entering into this Agreement, you and Finance Popular are each waiving the right to a trial by jury or to participate in a class action.
Indemnification
You agree to be personally responsible for your use of the Services, and you agree to defend, indemnify and hold harmless Finance Popular from and against any and all claims, liabilities, damages, losses and expenses (including attorneys' fees and accounting costs), arising out of or in any way related to (i) your access to, use of or alleged use of the Services; (ii) your violation of the Terms or any applicable law or regulation; (iii) your violation of any third-party rights, including, without limitation, any intellectual property, publicity, privacy, proprietary or confidentiality rights; or (iv) your use of a third-party's services and any dispute or issue between you and a third-party. Financer.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.
Disputes
If you wish to raise a formal dispute, you may do so through the European Commission's Online Dispute Resolution procedure. This procedure will help you access the appropriate dispute resolution body. Finance Popular cannot accept responsibility for errors made by the selected supplier or respond to complaints on its behalf. The procedure for the dispute will be in accordance with the European Commission's regulations then in force, and the language of the procedure will be French.
These conditions and any dispute concerning these conditions (including, without limitation, their validity, performance, interpretation, termination, etc.) will be governed by and in accordance with the laws of France.
Notes on the Terms
a) Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire and exclusive agreement between you and Finance Popular regarding your use of and access to the Services.
b) No Waiver
Our failure to require performance of any provision does not affect our right to require performance of that provision at any time thereafter, nor shall a waiver of any breach or default of the Terms constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
c) Document Format
The use of paragraph headings or other formatting options in the Terms is for convenience only and shall not affect the interpretation of the provisions, unless otherwise expressly provided in these Terms.
d) Severability
If any part of the Terms is held to be invalid or unenforceable, the unenforceable part shall be enforced to the maximum extent possible and the remaining parts shall remain in full force and effect.
e) Conclusion
These Terms are published on the Finance Popular Site, and are considered public offers available to each user, who meets the requirements hereof. By accessing any part of the Finance Popular Site or Service, the user accepts this offer, and no other document must be executed (whether on paper or in electronic form) to confirm it.

Where Finance Popular has provided a translation of the French version of any part of the Terms, you agree that the translation is provided for your convenience only and that the French version of the Terms will govern your relationship with us and the services we provide to you. In the event of any discrepancy between the English version of the Terms and its translation, the English version will prevail.
